Terms of Service

These Terms of Service govern the use of services provided by YOURCORE. By using our services, clients agree to these terms.

1. Scope of Services

YOURCORE provides consulting, implementation, development, and support services related to artificial intelligence solutions for real estate businesses.

• AI qualification systems (WhatsApp, voice)
• BANT scoring and lead qualification models
• Automation workflows (n8n, Zapier)
• Software integrations (CRM, database, communication platforms)
• Analytics systems and performance reporting
• Technical support and maintenance

2. Client Responsibilities

• Provide accurate and complete business information
• Supply necessary lead/inquiry data in usable formats
• Cooperate fully during implementation phases
• Maintain access credentials securely (do not share API keys, passwords, or tokens)
• Obtain all required legal permissions for data collection and processing
• Maintain compliance with telecom regulations and anti-spam laws

3. Payments

• Project-based: 50% upfront (contract signature), 50% upon delivery
• Retainer: Due on the date of the contract signed each month
• Enterprise: Per custom agreement

Late Payment: Service suspension after 3 days overdue. Late fees of 1.5% per month (18% annually) on outstanding balance. Failure to pay may result in contract termination.

4. Intellectual Property

Pre-existing IP (YOURCORE methodologies, frameworks, templates) remains owned by YOURCORE. Custom-developed deliverables transfer to client upon complete payment. Custom code and configurations remain your property post-project.

YOURCORE Retains: Internal methodologies, proprietary BANT scoring algorithms (core model), reusable templates and integrations, tools and processes used across multiple clients.

License Grant: Client receives a non-exclusive license to use custom deliverables for internal business purposes. Resale, redistribution, or reuse for competing real estate services is prohibited.

5. Confidentiality

Both parties agree not to disclose confidential information without written permission. This includes business and financial data, customer information, technical specifications, pricing, and performance metrics.

Public Disclosure: YOURCORE may publicly identify client as a user (logo, testimonial) unless client opts out in writing.

6. Service Availability

YOURCORE does not guarantee uninterrupted availability due to third-party outages, scheduled maintenance (max 4 hours/month, 48-hour notice), infrastructure failures beyond YOURCORE control, or force majeure events.

7. Limitation of Liability

YOURCORE shall not be liable for lost profits or revenue, indirect/incidental/consequential damages, data loss or corruption, business interruption, third-party service failures, or client misuse.

Total Liability Cap: YOURCORE total liability shall not exceed the amount paid by client in the 12 months preceding the claim.

8. Warranties & Disclaimers

YOURCORE warrants that services will be performed in a professional and workmanlike manner. YOURCORE does not guarantee specific conversion rates, lead quality, client adoption, or market outcomes. AI systems improve with data and feedback. YOURCORE is not responsible for third-party service availability or changes.

9. Data Security

• Encryption at rest (AES-256) and in transit (TLS 1.2+)
• Access controls and role-based permissions
• Automated backups with geo-redundancy
• Regular security audits and vulnerability scanning

No internet-based system is completely secure. While reasonable safeguards are implemented, absolute security cannot be guaranteed.

10. Data Handling & Retention

During Engagement: Client data is stored privately & securely. Backups are automated daily with 30-day retention. Client can request data export at any time.

After Termination: All client data is deleted within 30 days of contract end (unless export requested). Client retains all custom workflows, code, and configurations.

Legal Hold: Data retained beyond 30 days if required by law or legal proceeding.

11. Termination

Project-based engagements cannot be terminated without cause. Retainer engagements can be terminated with 30 days written notice. Outstanding balances remain payable. Access to systems is revoked within 24 hours of termination.

12. Modifications to Terms

YOURCORE reserves the right to update these terms with 30 days notice. Continued use of services constitutes acceptance of modified terms.

13. Governing Law

These Terms are governed by the laws of India (Delhi jurisdiction). Any disputes shall be resolved through good-faith negotiation, mediation, or arbitration (not litigation).
